If a product is found to be defective by Eleveight, in its sole discretion, Eleveight’s only responsibility shall be limited to repair or replacement of the defective product.

Eleveight will not be responsible for any costs, losses or damages incurred as a result of loss or use of product.

This warranty is subject to the following limitations:

1. The warranty applies only to Eleveight products purchased from Authorized Eleveight Dealers and is valid for the original purchaser only.
2. All products returned to Eleveight for warranty inspection must receive prior return authorization which can be given over the phone. If shipping products direct we recommend using a tracked/insured service. Eleveight assumes no responsibility for products during shipment from the customer to our Warranty Department. Shipping charges are not refundable.
3. Excluded from coverage under this warranty are the following:
   • Damage caused by misuse, abuse or neglect.
   • Damage caused by improper mounting or adjustment of the fins, pads and straps.
   • Normal wear and tear including, but not limited to, punctures and canopy tears, rigging with other than Eleveight components, damage due to excessive sun exposure, or damage due to over inflation of the bladders, damage caused by improper handling and storage, damage caused by use in waves or shore break, and damage caused by crashing the kite at high speed or damage caused by anything other than defects in material and workmanship.
   • Surfboard breakage under any conditions
   • Damage caused by rental or teaching operations
   • Damage caused by rocks or other obstacles and any other impact related damage
   • Damage caused by use of solvents, adhesives or LOC-TITE®.
   • Any and all claims for consequential or incidental damages
4. All coverage under this warranty is void if any modification, change or alteration has been made to the product that is not specifically authorized in writing by Eleveight
5. Repaired or replaced products are covered for the remainder of the original warranty only.
6. Repaired items will be subject to available parts. We will do our best to match colours and styles but we cannot guarantee that you will receive the exact product back
7. All warranty claims must be accompanied by the original purchase receipt from an Authorized Eleveight Dealer. Invoice or charge receipt must clearly identify the dealer.

THE FOREGOING LIMITED WARRANTY IS EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES OF QUALITY AND PERFORMANCE, WRITTEN, ORAL OR IMPLIED AND ALL OTHER WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, ARE HEREBY DISCLAIMED. IN NO EVENT SHALL ELEVEIGHT BE LIABLE FOR SPECIAL, INDIRECT, INCIDENTAL, CONSEQUENTIAL, STATUTORY OR EXEMPLARY DAMAGES, WHETHER IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE including, without limitation, loss to property other than this product, loss of use of said product, or other property or other economic losses. Eleveight Kitesurfing shall not be liable for contribution or indemnification, whatever the cause. Some jurisdictions do not allow limitations on how long an implied warranty lasts and/or the exclusion or limitation of incidental or consequential damages, so the above limitation and exclusion may not apply to particular customers. Eleveight obligations under any warranty shall be limited, to the greatest extent allowed by law, as provided in this Eleveight Limited Warranty. This Limited Warranty gives you specific legal rights; you may also have other rights, which vary from one jurisdiction to another.
